One of the aspects that has not been duly resolved in the field of patrimonial responsibility of the Administrative State in Chile, is related to the necessary requirements for it to be able to claim reimbursement against the official who has incurred in personal fault, as a result of what which, the State has been previously sentenced to pay the damages or losses caused. In this context, we will review and analyze the need for the administrative body, prior to deducing its repetitive action against the official, to initiate a disciplinary administrative procedure.
