VICARIOUS VIOLENCE: CONCEPTUAL FRAMING, SCOPE, AND LEGAL APPROACHES

The article analyzes vicarious violence as a form of substitute violence, where the aggressor uses children, relatives, animals, or other significant beings to harm the woman. Based on historical and jurisprudential precedents, such as rulings of the European Court of Human Rights and Decision 47/2012 of the CEDAW Committee, it examines its recognition in international law and national legislation. Conceptual debates about its relation to gender-based violence are discussed, and various manifestations are described: psychological, economic, judicial, relational, and physical, including linked femicide. Finally, the article highlights that vicarious violence constitutes an extreme expression of gender inequality, requiring legal responses, preventive measures, and comprehensive reparation for the victims.
