VIOLÊNCIA VICÁRIA: ESTRUTURA CONCEITUAL, ÂMBITO DE ALCANCE E RESPOSTAS LEGAIS

Resumo

This article analyzes vicarious violence as a form of substitute violence, in which the perpetrator uses children, relatives, animals, or other significant figures to harm the woman. Based on historical and jurisprudential precedents, such as the rulings of the European Court of Human Rights and Opinion 47/2012 of the Committee on the Elimination of Discrimination against Women (CEDAW Committee), its recognition in international law and national legislation is examined. Conceptual debates on its relationship to gender-based violence are discussed, and various manifestations are described, including linked femicide. Finally, it is emphasized that vicarious violence constitutes an extreme expression of gender inequality, demanding legal responses, preventive measures, and comprehensive reparations for victims.
