Abstract

This research focuses on identifying the power of control exercised behind digital platforms and analysing bargaining inequality and algorithmic opacity as problems arising from its exercise. In turn, the work will focus on the presumptions of employment and initiatives that promote greater transparency in the implementation
of automated decisions, as mechanisms that seek to counteract the harmful effects of the exercise of managerial power behind this new environment. Based on this background, Law No. 21,431 will be evaluated, and the need for greater caution in favour of workers covered by the regulations will be justified, given that, in its current form, the legislation has shortcomings that do not effectively solve the problem of inequality and algorithmic opacity.
