This contribution analyzes the most important aspects of a Supreme Court ruling that substituted the prison sentence of a woman who gave birth while serving her sentence. A brief analysis is also made of three similar cases in which similar arguments were used. From this study, it is concluded that the use of a gender perspective in judicial decisions fulfills an important need in our penitentiary system, such as the lack of alternatives to the deprivation of liberty for pregnant women.
