Abstract

The entry into force of Law No. 21.202 has brought us an administrative litigation action against the administrative procedure that it regulates. For the present work we have read all the jurisprudence on urban wetlands up to March 2023 and we have identified as one of the critical knots of this litigation the relationship between conservation and the motivation of the administrative act. For this paper we have deliberately chosen the sentences to be analyzed because they express the criterion that we seek to explain and to expose the dogmatic criteria that we intend to confront in the commentary.
