The objective of this work is to analyze the existence and scope of certain mechanisms designed to prevent and control abuses in contracts between businesses under Chilean law, identifying critical issues in some provisions of the national legal system and examining how legal scholars have addressed this problem. Furthermore, from a comparative perspective, it reviews how certain soft law instruments and the Argentine Civil and Commercial Code address protection against contractual asymmetries outside the consumer sphere.
