EL FAVORECIMIENTO PERSONAL HABITUAL COMO FORMA DE ENCUBRIMIENTO PUNIBLE

Resumen

El artículo presenta una caracterización general de las variantes de encubrimiento previstas en el Código Penal chileno, que se sustenta en su comprensión como una forma de intervención post-ejecutiva, de naturaleza dependiente, pero no accesoria, en un hecho punible. Sobre esta base se analiza la especificidad del así llamado “favorecimiento personal habitual”, definido en el Nº 4 de su art. 17, cuyas particularidades no logran revertir su categorización como una forma dependiente de intervención post-ejecutiva. Especial atención es prestada a la conexión interna que se da entre la exigencia de habitualidad que ha de satisfacer el comportamiento favorecedor y la modificación que experimenta el requisito general de imputación subjetiva. El trabajo se cierra con una indagación en las consecuencias que de ello se
siguen para el régimen de prescripción de la acción penal. 

The paper presents a general characterization of the different sorts of so called “after-the-fact” liability recognized by the Chilean Penal Code, grounded upon its understanding as a form of dependent, yet non-accessory, intervention in a criminal offense. Upon this basis, the specificity of so called “habitual personal favoring”, defined in its Art. 17 No. 4, is analyzed, the particulars of which are insufficient for reversing its categorization as an “after-the-fact” dependent mode of intervention. Special attention is paid to the internal connection that holds between the requirement of “habitualness” that needs to be satisfied by the favoring-behavior and the modification operated on the general requirement of mens rea. The paper closes with an inquiry into the consequences the thus presented account has for the application of the statute of limitations.
